- Welcome to NGDS (Next Gen Data Storage). These Terms and Conditions (“Terms”) govern your use of our website, cloud storage services, applications, and any other related products and services (collectively, the “Services”) provided by NGDS (“we”, “our”, or “us”).
- By accessing or using NGDS, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
1. Eligibility:
- You must be at least 13 years of age (or the minimum legal age in your jurisdiction) to use our Services. By using NGDS, you represent and warrant that you have the legal capacity to enter into a binding agreement.
2. User Accounts:
- Registration
To access certain features of our Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to update your information as necessary. - Account Security
You are responsible for maintaining the confidentiality of your account credentials. NGDS is not liable for any loss or damage arising from unauthorized access to your account.
3. Services and Usage:
- Service Description
NGDS provides secure cloud storage and data management services. Features may include secure file sharing with permission levels, password-protected and expiring share links, resumable large-file uploads, and access from the web and the Android app. - Acceptable Use
You agree not to misuse the Services or use them to:- Upload or distribute unlawful, harmful, or abusive content;
- Infringe on intellectual property rights;
- Transmit viruses, malware, or other malicious software;
- Attempt to gain unauthorized access to other accounts or networks;
- Violate any applicable laws or regulations.
4. User Content:
- Ownership
You retain ownership of all files, data, and content you upload or store using NGDS (“User Content”). By uploading content, you grant NGDS a limited license to store, transmit, and process your content as necessary to provide the Services. - Responsibility
You are solely responsible for your User Content and for ensuring that it complies with applicable laws and these Terms.
5. Plans, Payments & Billing:
- Subscription Plans
NGDS offers various subscription plans, including free and paid options. Details of each plan, including storage limits and features, are available on our pricing page. - Billing
By subscribing to a paid plan, you agree to pay all fees and charges associated with your account. Fees are billed in advance and are non-refundable, unless required by law. Payments are made by UPI QR code or, where available, with NGDS coins. - Renewal
Paid plans run for the period you purchase and do not renew automatically. We may email you a reminder before a plan expires. If a plan expires, your account reverts to the free plan.
6. Termination:

You may ask us to close your account at any time by emailing infongds@gmail.com. - By NGDS
We reserve the right to suspend or terminate your account and access to Services if you violate these Terms, engage in illegal activities, or create harm or risk to NGDS or other users.
Upon termination, your data may be deleted from our servers. Files you delete yourself stay in the recycle bin for 30 days before they are permanently deleted. It is your responsibility to back up your content before termination.
7. Privacy:
- Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
8. Data Security:
- NGDS implements industry-standard security measures to protect your data. However, no method of transmission or storage is completely secure. You acknowledge that you use our Services at your own risk.
9. Intellectual Property:
- All content and materials on NGDS (excluding your User Content), including logos, software, and designs, are the property of NGDS or its licensors and are protected by intellectual property laws.
- You may not copy, modify, distribute, sell, or lease any part of our Services or content without prior written consent.
10. Limitation of Liability:
- To the fullest extent permitted by law, NGDS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or revenues arising out of your use or inability to use the Services.
11. Modifications to Terms:
- We may update these Terms from time to time. If we make significant changes, we will notify you by email or through the Services. Continued use after such changes indicates your acceptance of the revised Terms.
12. Governing Law:
- These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be resolved exclusively in the courts located in India.
